    This is an easy one. I am sorry but i am blank on this.

    Can you please let me know how do i get a soft copy of the passport size photograph? I used to get the hard copy from Sam's but now we need to softcopy to upload for visa purposes (D160).

    Thank you for any direction.

    My attorney is encouraging me to take part in the proposed AILF Class Action Lawsuit against the Government by submitting I-485 to USCIS knowing that its going to be rejected. Anyone decided on this? What are the pros and cons? If there is a favorable outcome, I-485 may be accepted at that time (months? / years?). But here is my big concern: if I am a part of that lawsuit, my 485 may be considerably delayed (my PD is Feb 2005) ! I am aware that IV is encouraging lawsuit too. Any comments?

    Hello,

    I am currently on H4 visa and I am planning to pursue an MBA program. If i choose to study in H4, i know i qualify for the California resident fee discount. If i change my visa to F1 for studies, would i not be eligible for the california resident discount? or would i lose the residency status?

    I believe filing CPT and working on CPT till EAD (if filed with 485) arrives in hand should not affect pending I-485 at all.

    Can somebody else in this situation confirm this?

    This should be quite a common issue.

    Hi,

    I filed my EAD and AP renewal on Sept 17 (20 days) ago but still I haven't heard received neither receipt notice nor my check being cashed. Is there anything we can do to find out about the receipt notice? Fedex tracking shows the mail being already delivered. I am currently working on EAD and recently used AC21 to switch the company so EAD is very important to me.

    Please provide your feedback and if anyone is having same delays in getting receipt notice for EAD / AP.

    Hello,

    My Present H1B stamp is with company A and expires November 20 2007. Now I'm with company B and with this I have my petetion (H1B approval) which expires June 20 2008. Now I'm travelling to India for my marriage and coming back September 8. I'm not getting the new stamp this time. Will I have any problem during the immigration ??

    Also with my present papers, my wife would be attending her visa Interview on Sep 4. Will there be any problem for her at the interview ???

    Just make sure you show you approved 797 petition from company B ( for whom you are working ) at POE to the immigration officer so he can enter the correct employer in their system and also gives u the correct I 94 which should expire on June 20 2008.

    Here is my suggestion:

    Apply for H-4 as this should be straight-forward and fly your wife the US in March. Prepare H-1 papers and get it ready to reach USCIS on April 1st.

    If H-1 is acceped in lottery(assuming there is going to be one), then H-1 status starts from October 1st. For travel purpose your wife will have to get H-1 stamping (which can happen only after October 1st).

    Hope this helps.

    If am in your situation, i will go with the above approach...

    You have to withdraw old LC while filing the PERM hence prepartion can be parallel. It is better for you to file PERM ( you get it in 50 days or earlier) & get 140 ( 2 months after LC) & therefater apply for 3 years H! B extn.

    You will not have to go through H1B circus, if you & others support IV & atleast generate $$ which is really driving our effort other than core members.

    My I-485/I-140 were filed on Jul 2, 2007 (I-140 approved in 9/2007). I possess an EAD valid till Sep 2010 and AP valid till Aug 2009. I lost my job (H1B) in late January. I have a family emergency compelling me to travel to India for a week (starting Saturday next week 04/04/2009). Will there be any problem in terms of using my AP to re-enter the U.S? An early reply would be appreciated. Thank You very much in advance.

    P.S: I do not have a job yet.

    If its few months of outside work.. should be fine... But you can't and should not just leave and work outside until you get GC.. May work, but chances are rare.. So risk is up to you to take and decide...

    My I-140 approved. Based on the July 2007 Visa Bulletin revision threat on June 30th, I have prepared and submitted I-485 package with all necessary documents along with approved I-140 copy. I sent the package to Nebraska Service Center and it reached on July 2nd. In the last minute, my company also submitted the I-485 package. My company sent the package on July 1st and reached on July 2nd at Texas Service Center. This was happened due to some communication gap between my company and me.

    My questions are:
    1. Will there be any problem if there are two package submitted? One from me and one from my company law firm?
    2. Will they reject one of the package? If so, which one will be returned?
    3. Is it possible to withdraw one of the package?

    I'm not a Guru in Immigration Matters...still from my experience USCIS is pretty random in some cases with online statuses.
    I think I just told you what you know already, but reminding you that you are not alone.

    Hi,
    I am trying to renew my EAD/AP myself and wanted to check if I will be getting the EAD card and AP documents by mail to my address.

    I am avoiding the lawyer, as he's charging unreasonable amount.

    Question:
    When self-filing, would I be getting the EAD/AP documents at my home address???
